News Archive (4)Feb 25, 2015 (Newsletter Issue 3/15)Methodology for Trademark Examination AdoptedThe Institute for Intellectual Property of Bosnia and Herzegovina has adopted the Methodology for trademark examination which begins to apply from January 1, 2015.
This methodology explains practical implementation of the provisions of the Trademark Law and the Regulations on the Procedure for the Grant of a Trademark. It also serves as an instruction with clarifications and practical examples for conducting procedures before the Institute for Intellectual Property relating to trademark protection.

Accession to Lisbon Act
The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify the deposit by the Government of Bosnia and Herzegovina, on March 22, 2013, of its instrument of accession to the Madrid Agreement for the Repression of False or Deceptive Indications of Source on Goods of April 14, 1891, as revised at Lisbon on October 31, 1958, and to the Additional Act of Stockholm of July 14, 1967.
The Lisbon Act and the Additional Act of Stockholm will enter into force, with respect to Bosnia and Herzegovina, on June 22, 2013.

Feb 07, 2012 (Newsletter Issue 2/12)Accession to Vienna AgreementThe Government of Bosnia and Herzegovina has deposited its instrument of accession to the Vienna Agreement Establishing an International Classification of the Figurative Elements of Marks.
The said Agreement will enter into force on April 19, 2012.

New Trademark Law
Bosnia and Herzegovina has adopted a new Trademark Law, effective from January 1st, 2011.
In accordance with the adoption of the new law, the Institute for Intellectual Property of Bosnia and Herzegovina has adopted a new Book of Rules on Procedures for Trademark Registration
The Book of Rules was published in the Official Gazette in December 2010 and entered into force on January 1st, 2011.

Legal basis is the new Trademark Law (in force since January 1st, 2011).
Bosnia and Herzegovina is a member of the Madrid Protocol. The membership of the Madrid Agreement became effective on January 27, 2009.
Trademark protection is obtained by trademark registration.
Trademarks which were protected in former Yugoslavia are protected in Bosnia and Herzegovina only, if they have been transcribed until March 1, 2002.
ClassificationNice classification, 12th edition
What is Registrable as a TrademarkRegistrable as a trademark are all distinctive and graphically representable signs, such as words, names, acronyms, letters, numbers, devices, combinations of colours, the three-dimensional form of a good or its packaging and any combination of the mentioned signs.
The following trademark types are registrable: trade marks, collective marks and guarantee marks.
Registration ProceedingsThe application is filed at the Institute of Intellectual Property Rights of Bosnia and Herzegovina. The Offices are in Sarajevo, Mostar and Banja Luka.
Multiple-class applications are possible.
Foreign applicants need a local agent.
A non-legalised power of attorney is sufficient.
Foreign applicants do not need a domestic registration.
The application process includes a formal examination and an examination as to absolute grounds (eg. distinctiveness).
The processing time from first filing to registration or first office action is approx. 1 to 2 years.
After the examination on absolute grounds, the trademark is published in the official Gazette for opposition. Registration is the final step that comes after the opposition period has expired.
Opposition PeriodNational:The opposition period is 3 months from publication of the trademark application (non-extendable).

Trademark DurationA trademark registration is valid for 10 years from the date of application. The registration is renewable for periods of 10 years.

hereThe official fee for filing a trademark application is BAM 250 for up to three classes and BAM 25.for each additional class.
The registration fee (including 10 years maintenance and Issue fee) is BAM 670 for up to three classes and BAM 60 for each additional class. The publication fee is BAM 25 for up to three classes and BAM 5 or each additional class.
