Trade Marks Update


The anticipated commencement date of the Trade Marks Act 2023 is 1 February 2025. This is subject to the issuance of a formal commencement notice to be published 1 month in advance of the commencement date.

Pending the implementation of the new law, accompanying regulations are in the stage of being finalised and forms have been drafted and circulated for industry review and comment. The Government Fees (Trade marks) Regulations 2023 have also been published. The new law will allow for multi-class applications which will result in lower official fees for trade mark owners wishing to file in multiple classes.

International treaties such as the Paris Convention and Madrid Protocol have not yet been extended to Bermuda and therefore, related sections of the Trade Marks Act will not become operational in February 2025.

Furthermore, by way of transition to the new law the Bermuda Registry is no longer requiring the association of trade marks in the majority of cases, although there are some exceptions.
