Two-step trademark filing system changed


Starting September 20, 2025, the Brazilian Patent and Trademark Office (BPTO/INPI) changes how trademark applications are paid and prosecuted. The former two-step system — a filing fee and then a grant fee — is replaced by a single fee paid at filing. This covers the whole prosecution of the TM application: filing, examination, registration, and the first ten years of protection.

The BPTO is changing the system mainly because it is seeking efficiency. Under the old rules, once an application was allowed, the BPTO had to publish a notice and then wait 60 days for the ordinary payment term plus another 30 days for the extraordinary term. Only after that could it confirm payment and move forward with registration. This slowed down the process and created additional work to the BPTO.

With the new system, once an application is allowed, the registration certificate is issued automatically. For applicants that really want protection, this can be seen as a positive change because registrations are granted faster.
