Administrative Trademark Cancellation Actions would finally be processed


Trademark cancellation actions were exclusively court actions in Turkiye until 10 January 2024, which is when Turkish Patent and Trademark Office (“Turkish PTO”) has become the sole authority to process trademark cancellation actions.

Despite more than one year has passed since 10 January 2024, Turkish PTO has not been able to process any trademark cancellation actions, due to the lack of Implementing Regulation and lack of other groundworks, even though the PTO accepts requests and official fees for trademark cancellation actions for over a year.

The required Implementing Regulation for trademark cancellation actions has gone into effect on 15 March 2025, in a form as amendments of / additions to several provisions to Implementing Regulation to Turkish IP Law. This development appears to have completed all groundworks for administrative processing of trademark cancellation actions.

Turkish PTO is now under heavy workload of trademark cancellation actions due to piling up such actions for over a year.

Official payment required for a trademark cancellation action consists of two separate items, one is official fee [28,150.00 Turkish Liras, which is around 770.00 USD], and the other is security deposit [23,458.33 Turkish Liras, which is around 643.00 USD]. Security deposit will be paid to fully successful parti upon request. If no party is fully successful, security deposit will remain to Turkish PTO.
