New Trademark Law in force


The eagerly awaited new Bermudian trademark laws entered into force on August 1, 2025.

The official fees have changed. The fee to file a mark in one class is USD 269, and the fee for each additional class in a multi-class filing is USD 139, which effectively results in lower filing fees for mark holders registering in more than one class.

The new law also brings updates such as provision for priority-based filings, filing of certification and collective marks plus non-traditional marks such as colors and sounds, removal of the A/B-split registration system with different rights conferred under each part, and 10-year registration terms (14 years so far).

Owners with pending applications that have not yet been published may apply to request their applications be processed according to the new laws, which among other things would provide the applicant with a 10-year registration term instead of an initial seven-year term. This request must be made within six months of August 1.
