New rules for filing non-use applications


On May 26, the China National Intellectual Property Administration (CNIPA) issued new rules for filing trademark non-use cancellation applications.

Applicants must now:

State Non-Use – Explicitly claim the trademark has not been used for three consecutive years without justification.

Provide Preliminary Evidence – Submit initial proof, including market research, online searches, corporate status checks, and on-site investigations.

Make Formal Commitments – Confirm good faith, verify no market use, ensure information accuracy, and accept penalties for false submissions.

These updates shift more burden of proof to applicants, making non-use cancellation filings more demanding compared to the previous, easier process.
