Trademark procedure and enforcement strengthened under amended IP law


On 10 December 2025, Vietnam’s National Assembly adopted the Amended Law on Intellectual Property, which entered into force on 1 April 2026. For trademark owners, the reform introduces faster prosecution timelines and stronger enforcement tools.

Trademark applications must now be published within one month from formality acceptance, while the period for substantive examination has been reduced from nine months to five months. Accelerated examination is also available in certain cases.

The amended law further strengthens enforcement, particularly in the digital environment. Competent authorities have broader powers to remove or disable infringing content on websites, mobile applications and social media platforms. In addition, stronger remedies are available, including the mandatory destruction of infringing goods and materials. The statutory cap for damages has also been increased from VND 500 million to VND 1 billion.

Overall, the amendments enhance both the efficiency and enforceability of trademark protection in Vietnam.
