New rules for recognition of well-known trademarks


Kazakhstan has adopted new rules for the recognition of trade marks as well-known, effective February 10, 2026.

The rules apply to registered trade marks as well as unregistered designations that have acquired widespread recognition in Kazakhstan. Applications must be filed with the Ministry of Justice and must include comprehensive evidence of consumer recognition.

The new framework expands the types of accepted evidence, including advertising materials, sales data, media coverage, website traffic, social media statistics, search engine data, marketplace data, awards, expert opinions, and consumer surveys.

Applications are published and subject to a three-month opposition period. The rules also clarify grounds for refusal, including lack of distinctiveness or misleading character.

The changes raise the evidentiary threshold for well-known trade mark recognition while improving procedural transparency for brand owners.
