Revised Trademark Law Adopted


China adopted its revised Trademark Law on June 26, 2026. The new law will enter into force on January 1, 2027.

The reform restructures the law from 8 chapters and 73 articles to 9 chapters and 87 articles and reflects a stronger focus on the obligation to use trademarks, rather than registration alone.

Key amendments include:

- Trademark use through information networks, including the Internet, is expressly included in the definition of trademark use.
- Motion marks are introduced as a new type of registrable trademark, providing a legal basis for the protection of dynamic signs.
- The opposition period for preliminarily approved and published trademarks will be reduced from 3 months to 2 months.
- The law further clarifies standards for bad-faith trademark applications and introduces administrative penalties for certain bad-faith filing activities.
- Ex officio cancellation for non-use by CNIPA for trademarks that have not been used for three consecutive years without justifiable reasons.
- Stronger protection of well-known trademarks
- Clarification of circumstances for fair use of another party’s registered trademark
- Clearer obligations and stricter rules for trademark agencies, practitioners and industry organizations.
